These Terms of Use (“Terms”) govern your access to and use of the website https://artivex.xyz (“Website,” “Platform,” or “Service”), operated by:

(Collectively “Artivex,” “Company,” “we,” “our,” or “us.”)


By using the Platform, you agree to these Terms. If you do not agree, you must stop using the Platform immediately.

We may update these Terms at any time. Your continued use constitutes acceptance of the updated Terms.



1. Eligibility & Restricted Territories


1.1. You must be 18 years or older to use the Platform.


1.2. Artivex does not provide services to individuals or entities located in, or acting on behalf of, sanctioned jurisdictions, including:

  • Iran
  • North Korea
  • Syria
  • Cuba
  • Crimea, Donetsk, Luhansk regions
  • Any territory restricted under OFSI/OFAC/EU sanctions regimes


2. Services Provided


Artivex provides digital services related to AI-generated artwork, including:


2.1. Ready-Made AI Artwork (Stock Art)

  • Users may browse and purchase artwork available in our curated stock library.
  • Delivery is instant: purchased artwork immediately appears in the user’s Collection (Cabinet) with a download button.

2.2. Custom AI-Generated Artwork (Prompt-Based)

  • Users may purchase platform credits (“Balance Top-Up”).
  • Credits can be used to generate custom artwork using text prompts.
  • Delivery is instant or within several minutes depending on system load. The final artwork appears automatically in the user's Collection.

2.3. Service Completion

An order is considered completed when the digital artwork appears in the user’s Collection page with an active download button.
A system delivery notification may also be issued.



3. Step-by-Step Purchase Flows


3.1. Ready-Made Artwork Purchase Flow


  • User registers or logs in
  • User selects artwork
  • User chooses artwork size (if applicable)
  • User adds artwork to cart
  • User enters billing information
  • User accepts Terms & Privacy
  • User is redirected to hosted payment page
  • User completes payment
  • User returns to Artivex
  • Artwork becomes instantly available in the Collection
  • User may download files at any time

3.2. Credit Top-Up + Custom Generation Flow


  • User registers or logs in
  • User selects credit top-up amount
  • User enters billing information
  • User accepts Terms & Privacy
  • User is redirected to hosted payment page
  • Payment completes
  • Credits are added to account
  • User enters a text prompt
  • Artwork is generated instantly or within minutes
  • Artwork appears in the Collection
  • User may download files anytime


4. Account Registration


You agree to provide accurate account information, maintain account confidentiality, and notify us of unauthorized access.
You are responsible for all activity under your account.



5. Pricing, Currencies & VAT


Prices may be displayed in EUR, USD, GBP, AUD, NZD, NOK, CAD, SEK.

All prices include VAT where applicable.

Final currency conversion is determined by your payment provider.



6. Payment Terms & PCI Compliance


6.1. All card payments are processed securely by a third-party PCI-DSS Level 1 certified payment service provider.


6.2. Artivex does not store, process, or access cardholder data at any time.


6.3. By completing a purchase, you authorize us to charge your selected payment method.




7. Refunds & Digital Goods Waiver


7.1. Because Artivex delivers instant digital content, your legal “cooling off” right expires as soon as the artwork becomes available. You explicitly acknowledge that:


  • By completing the purchase, you consent to immediate digital delivery.
  • You thereby waive your statutory right to cancel under the UK Consumer Contracts Regulations 2013 or Directive 2011/83/EU (EEA).

7.2. Refunds may be granted only in the following cases:


  • The digital file is corrupted, incomplete, or cannot be downloaded within 14 days of purchase.
  • A technical error prevented generation or delivery.
  • A duplicate payment occurred due to system error.

7.3. Refund review time: 72 hours


7.4. Refunds are issued only to the original payment method.

8. Promo Codes


Promo Codes may be applied to:


  • Credit top-ups
  • Stock artwork purchases

Rules:


  • Discount applies to the payment amount.
  • Credits are added at their full value (pre-discount).
  • Codes cannot be used retroactively.
  • Multiple codes cannot be stacked unless explicitly stated.
  • Fraud or abuse may result in cancellation.


9. Intellectual Property & Licensing (Option 4)


9.1. Ownership


All Platform content, models, AI engines, interface elements, and stock artwork belong to Data Driven Dynamics Ltd or licensed third parties.


9.2. Licensing for Ready-Made Stock Artwork


You receive:

  • ✔ Commercial usage rights for your business projects
  • ✔ Right to modify and integrate into designs

You may NOT:

  • ❌ Resell the original file
  • ❌ Redistribute as stock or templates
  • ❌ Repackage or sublicense
  • ❌ Mint as NFTs
  • ❌ Claim original authorship of the file itself

9.3. Licensing for Custom AI-Generated Artwork


You receive:

  • ✔ Full commercial usage rights
  • ✔ Right to modify, distribute, print, or use in marketing
  • ✔ Right to integrate into products

Platform Resale Feature:

Custom AI-generated artwork created through the Artivex generator may be listed for resale exclusively within the Artivex Platform under Section 9A.


Restrictions:

  • ❌ You may not sell, distribute, or transfer the artwork outside the Artivex Platform as a standalone downloadable product.
  • ❌ You may not mint the artwork as an NFT.
  • ❌ You may not make the artwork available as stock content or in AI training datasets outside the Platform.


9A. Artivex Market Feature


9A.1 Eligible Content


Only artwork generated through the Artivex AI generation system may be listed for resale within the Platform.

Ready-made stock artwork cannot be relisted.


9A.2 Platform-Managed Resale Functionality


Artivex provides a centrally managed digital resale functionality.

The Company:

  • Acts as Merchant of Record for all transactions.
  • Processes all payments directly through its PCI-DSS Level 1 certified payment service provider.
  • Does not facilitate direct user-to-user payments.
  • Does not provide escrow services.
  • Does not operate money transmission services.

All financial transactions occur exclusively between the buyer and the Company.

No peer-to-peer financial settlement occurs at any time.


9A.3 Digital Transfer Mechanism


Upon successful purchase:

  • The artwork is permanently removed from the seller's Collection.
  • The seller loses download access.
  • The artwork is added to the buyer's Collection.
  • The buyer gains exclusive access within the Platform ecosystem.

This mechanism ensures single-account availability of the file within the Platform environment.



10. Prohibited Activities


The following activities are strictly prohibited:


Illegal or High-Risk Content

  • Pornography, minors, sexual exploitation
  • Violence, hate, extremism
  • Terrorism or radicalization
  • Intellectual property infringement

High-Risk Sectors (Visa/MC)

  • Illegal drugs or substances
  • Weapons, explosives
  • Gambling or betting
  • High-risk financial schemes
  • Laundering, scams, fraud

Technical Misuse

  • Attempting to reverse engineer Artivex
  • Interfering with Platform systems
  • Circumventing payment or licensing restrictions

Violation may result in immediate account termination.



11. Evidence Retention


To comply with dispute-handling procedures and card-scheme rules, Artivex stores:


  • Order logs
  • File-upload timestamps
  • Payment confirmations
  • IP access logs
  • Delivery evidence

Retention period: 24 months minimum.



12. Limitation of Liability


To the maximum extent permitted by law:


  • Artivex is not liable for indirect damages.
  • Our liability is capped at the amount paid for the affected order.
  • Digital artwork is provided “as-is.”


13. Account Suspension & Termination


We may suspend or terminate accounts that engage in:


  • Prohibited activities
  • Fraud or chargeback abuse
  • Licensing violations
  • Malware or system attacks


14. Governing Law


The Terms are governed by the laws of England and Wales.
Jurisdiction: Courts of England and Wales.
