  • User or you: Refers to any individual who accesses or uses our platform.

  • User-Generated Content: Refers to any content created or uploaded by users on our platform.

We may modify these Terms from time to time, so we encourage you to review them regularly to stay informed about any updates. Your continued use of our platform after any modifications signifies your acceptance of the updated Terms.



4. User Eligibility


By using our platform, you represent and warrant that you are of legal age in your country of residence to enter into these Terms. Our platform is intended for use by individuals who are at least 18 years old. If you are under 18, you must not use our platform without the consent of a parent or legal guardian.



5. Services Offered (Updated)


Artivex allows users to:


  • Generate AI-generated artwork using tokens purchased through the platform.

  • Purchase exclusive AI-generated artwork from our stock.

The user registers an account or logs in → The user selects AI art from the gallery → The user chooses the preferred size of the selected artwork → The user adds the chosen artwork to the cart → The user fills in billing information → The user accepts the Terms of Service and Privacy Policy → The user is redirected to the payment provider’s page → The user completes the purchase using a payment card → The user is redirected back to the website → The user downloads the purchased artwork from the Collection page in the User Cabinet.


Alternative Flow (Credit Top-Up and Custom AI Art Generation)


The user registers an account or logs in → The user chooses to top up balance credits → The user fills in billing information → The user accepts the Terms of Service and Privacy Policy → The user is redirected to the payment provider’s page → The user completes the purchase using a payment card → The user is redirected back to the website → The user generates custom AI art using text prompts → The user downloads the generated artwork from the Collection page in the User Cabinet.



6. Account Registration


To access certain features of our website, you may need to create an account. You agree to:


  • Provide accurate, current, and complete information.

  • Maintain the confidentiality of your account credentials.

  • Notify us immediately if you suspect any unauthorized use of your account.

Your user account is personal and non-transferable. You are responsible for all activities that occur under your account.



7. Purchases and Payments


7.1. All purchases, including tokens and AI-generated artwork, must be made through our website. Users can choose from multiple currencies displayed on the platform.


7.2. Payments must be made using the methods specified on our website. By completing a purchase, you authorize us to process the payment via the chosen payment method.


7.3. Taxes and charges: You are responsible for any applicable taxes or duties imposed on your purchases. Prices displayed may not include taxes or additional charges, which will be provided during the checkout process.


7.4. Our services are not offered to, or directed at, individuals or entities located in the United Kingdom. We do not promote, supply, or deliver any goods or services within the territory of the UK. No part of our service infrastructure, fulfillment, or delivery is carried out from within the United Kingdom, nor are our services intended for UK residents or UK-based users.



8. Discount Codes and Promo Coupons


8.1. General Terms


Artivex may occasionally provide users with discount codes or promotional coupons (“Promo Codes”) that can be applied during purchases or balance top-ups on the platform.
By using a Promo Code, you agree to these Terms and any additional conditions specified in the corresponding promotion.


8.2. Application of Promo Codes


Promo Codes must be entered before completing the payment. Once applied, the system automatically validates the code and recalculates the payable amount.
The discount applies only to the current transaction and cannot be used retroactively for previous purchases.


8.3. Top-Up Logic (Balance Credits)


When topping up your account balance with an active Promo Code:


  • The discount is applied at checkout, reducing the amount you pay, not the credits you receive.

  • You receive the full credit value equal to the amount you entered before the discount was applied, but calculated in currency value, not in credits.

  • Example: If you top up 10 USD using a discount, you may pay less (for instance, 9.50 USD) but still receive credit equivalent to 10 USD, which converts to approximately 9.71 credits based on the platform’s internal rate.

8.4. Standard Orders (Purchases Without Balance)


If your balance is zero, the Promo Code applies directly to the order price, reducing the amount shown at checkout. You then pay the discounted total through the payment provider.


8.5. Standard Orders (Purchases With Balance)


If you have an active balance in your account:


  • The discount is first applied to the total order amount.

  • The discounted price is then deducted from your available balance.

  • If the balance is insufficient, only the remaining difference is charged via the payment provider.

  • If your balance covers or exceeds the discounted total, payment is fully deducted from your balance at the discounted rate.

8.6. Restrictions and Validity


  • Each Promo Code is valid for a limited period as specified in its announcement.

  • Promo Codes cannot be exchanged for cash, credits, or combined with other active offers unless explicitly stated.

  • Artivex reserves the right to modify, suspend, or cancel any Promo Code promotion at its sole discretion, including in cases of technical error, misuse, or suspected fraud.


9. Delivery Policy


Upon successful completion of your purchase, you will receive digital files associated with your order directly to your account within 1-3 business days. While we strive to ensure timely delivery, factors beyond our control may occasionally cause delays.



10. User Responsibilities


You agree not to:


  • Use the website or services for any unlawful purpose.

  • Attempt to reverse engineer, duplicate, or replicate the artwork or underlying technology.

  • Resell or redistribute artwork purchased on the platform without explicit permission.



11. Intellectual Property


11.1. All intellectual property rights in the AI-generated artwork and website content belong to Data Driven Dynamics Ltd or our licensors.


11.2. Upon purchase, you are granted a non-exclusive, non-transferable license to use the artwork for personal or commercial purposes, subject to any limitations outlined at the time of purchase.




12. Limitation of Liability


To the fullest extent permitted by law:


  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our website or services.

  • Our liability is limited to the amount paid by you for the service or artwork.


13. Privacy and Data Protection


We handle your personal data in accordance with our Privacy Policy, which complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.



14. Termination


We reserve the right to suspend, terminate, or restrict your access to our platform and your account at any time, without prior notice or liability, for any reason, including violation of these Terms.



15. Governing Law and Jurisdiction


These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
